On 22 February 2018, the Privacy Act will be amended requiring early childhood education and care providers to take certain steps if any personal or sensitive information they hold about families and/or children, is improperly accessed, disclosed or lost, attracting fines up to $1.8 Million.

Services will be required under the amendments to proactively protect the personal and health related data they hold and report qualifying breaches to the Office of the Australian Information Commissioner (OAIC).

Examples of Data Breaches:

  • A dismissed employee taking the services emergency contact list home and spending the weekend texting parents about the service.
  • Child specific medical or allergy information being on display or accessible by other parents.
  • Children’s data on an iPad being accessed at a party or left on a train and not logged off.

    Seminar attendees will receive:

    • A detailed briefing on the changes and discussion on processes currently used by most services that are not compliant with the new obligations.
    • Instruction on Identification and evaluation of breaches and the risks they pose.   Containment of breaches, notification to the OAIC and appropriate disciplinary action for breaches caused by staff.
    • An updated privacy policy (word format) with additional clauses for inclusion on your services web site.
    • Breach evaluation and reporting templates.
